Terms of Service

1. Parties and Scope

These Terms of Service govern the relationship between POI369 OÜ (Tallinn, Estonia (set LEGAL_ADDRESS in env for full address), registry code: PENDING — set LEGAL_REGISTRY_CODE in env) and any individual who accesses or uses the Faltastik platform. By accessing the platform, you agree to these terms.

2. Service Description

Faltastik is a digital entertainment platform offering AI-assisted interpretations across multiple divination formats — including astrology, tarot, coffee-cup reading, palm reading, dream interpretation and related content. All content provided is for entertainment purposes only and does not constitute medical, legal, financial or psychological advice. 3. Account and Age Requirement

• You must be at least 18 years of age to use the service.
• You are responsible for ensuring that any information you provide during account creation is accurate and up to date.
• You are responsible for the security of your account credentials and for notifying us promptly of any suspected unauthorised access.

4. Payment and Subscription

• Payments are processed securely via Stripe.
• Subscription fees are charged monthly or annually depending on the selected plan. The applicable currency is displayed at checkout.
• Local taxes (including VAT where applicable) may be added to your invoice in accordance with the laws of your jurisdiction.
• If you reside in Turkey, the Regulation on Distance Contracts and Law No. 6502 on Consumer Protection apply in addition to these terms, preserving your statutory consumer rights.

5. Intellectual Property

• Content you input into the platform (question text, images, etc.) remains yours.
• Reading outputs generated by Faltastik, the platform interface, brand name and logo are owned by POI369 OÜ. You may share outputs for personal, non-commercial purposes; any other use requires prior written consent.

6. Refunds and Right of Withdrawal

Conditions for refunds on digital service purchases are set out in a separate document. Please read our Refund Policy.

7. Prohibited Conduct

• Using the platform with automated tools (bots, scrapers).
• Manipulating the system for unlawful or unethical purposes.
• Attempting to gain unauthorised access to other users' accounts.
• Reverse engineering or tampering with our software.

8. Suspension and Termination

We may suspend or terminate your account without prior notice if a breach of these terms is detected. Where the breach is not intentional, a warning will be sent by email before termination.

9. Limitation of Liability

Faltastik is not liable for the accuracy of reading content or for decisions made by users in reliance on such content. In the event of temporary service unavailability, our maximum liability is limited to the subscription fees you paid in the preceding 3 months.

10. Governing Law and Jurisdiction

These terms are governed by Estonian law. However, for consumer contracts, the mandatory consumer protection provisions of your country of residence continue to apply and are not displaced by these terms. For users residing in Turkey, rights under Law No. 6502 and its regulations remain in full force. Disputes will first be referred to mediation; unresolved matters will be heard by the courts of Tallinn, unless a mandatory consumer court venue in your country of residence applies.
